The Information and Privacy Commissioner, Michael Harvey, has released his Report A-2020-025 under authority of the Access to Information and Protection of Privacy Act, 2015. A summary of the Report is included below.

Summary: The Complainant requested all notes and minutes taken during the meeting of October 23, 2018 of the House of Assembly Management Commission. The House of Assembly responded that minutes did not exist, and that notes were withheld under section 41 of the Access to Information and Protection of Privacy Act, 2015 (“ATIPPA, 2015”) (disclosure of House of Assembly service and statutory office records). The Complainant filed a complaint with our Office. The Commissioner accepted the House of Assembly’s conclusion that minutes did not exist. The Commissioner also concluded that section 41 prohibited the disclosure of the notes, and recommended that the House of Assembly continue to withhold them.
