New Legislation Increases Safety for Off-Road Vehicle Users

The Off-Road Vehicles Act, replacing the Motorized Snow Vehicles and All-Terrain Vehicles Act, was passed in the House of Assembly this week, enhancing safety for all off-road vehicle users in Newfoundland and Labrador.

The Bill was amended to include a requirement that a person must be able to keep both feet on the pedals, or foot rests, designed for use by the operator of a mini-bike, dirt-bike or trail-bike. This replaces the original proposed requirement that a person must be able to keep both feet on the ground when operating this type of off-road vehicle.

The Bill was also amended to include a prohibition that a person under the age of 16 must not operate an off-road vehicle that has an engine size that exceeds the manufacturer’s recommendation for an operator of their age and weight. This replaces the original proposed prohibition that a person under the age of 13 must not operate an off-road vehicle with an engine size greater than 125 cc.

Both amendments encourage off-road users to operate vehicles of a size appropriate to them. In particular, young operators must be of sufficient size and strength to reach and operate all controls while seated in the driver’s position.

Before the Off-Road Vehicles Act comes into force, Regulations are to be finalized and published. Government will also be working with safety partners to ensure training is widely available for those required to complete training in order to operate an off-road vehicle.
