June 9, 2021

The Honourable John Hogan, Minister of Justice and Public Safety and Attorney General, has released the report of the statutory review of the Access to Information and Protection of Privacy Act, 2015 (ATIPPA).

Conducted by former Chief Justice David B. Orsborn, the independent review makes approximately 150 recommendations and suggestions to the Government of Newfoundland and Labrador. The report is available online here.

The recommendations apply to all public bodies defined in the Act, including government departments, agencies, health boards, school boards and municipalities.

Some of the key recommendations include:

  • Changes to internal administrative procedures to improve access;
  • Increased transparency and oversight of Nalcor;
  • The development of a regulatory oversight regime for political parties;
  • The extension of the intergovernmental relations exception to cover all Indigenous self-governing bodies; and,
  • Provisions that would see more public bodies being subject to complete privacy assessments on the programs and services they provide.

The Provincial Government will immediately commence work to review and evaluate the recommendations and consult with stakeholders to determine how best to proceed.

Minister Hogan will be available to media today (Wednesday, June 9) in the lobby of Confederation Building, East Block, at 1:15 p.m.

We will now take the time required to carefully review the recommendations and consult before proceeding to next steps.”
