Public Advisory: Occupational Health and Safety Charges Laid Against Hurricane Industrial Equipment and Blue Water Agencies

Nova Scotia-based companies Hurricane Industrial Equipment Incorporated and Blue Water Agencies Limited have been charged with violations under Newfoundland and Labrador’s Occupational Health and Safety (OHS) Act and Regulations.

The charges result from an investigation by the Department of Digital Government and Service NL’s Occupational Health and Safety Division into an incident which occurred in July 2020, resulting in serious injuries to an employee of Hurricane Industrial Equipment Incorporated at Blue Water Agencies Limited’s worksite in Conception Bay South.

Hurricane Industrial Equipment Incorporated is charged with two violations under the OHS Act and Regulations relating to its alleged failure to:

  1. Provide a safe workplace, and the necessary equipment, systems and tools that are without risk to workers, and
  2. Ensure that safe work procedures were followed at the workplace.

Blue Water Agencies Limited is charged with two violations of the OHS Act and Regulations relating to its alleged failure to:

  1. As a Principal Contractor, to ensure that employers and workers performing work in respect to a project, comply with the OHS Act and Regulations, and
  2. As an employer, to ensure that its OHS Program was implemented, in particular with respect to contractors.

The companies’ first appearance is scheduled for May 16, 2022, at Provincial Court in St. John’s.
