The Provincial Government is updating the application and renewal structure for Commissioner for Oaths. Effective today, February 1, 2024, all new applicants will require a certificate of conduct from either the Royal Newfoundland Constabulary, the Royal Canadian Mounted Police or Commissionaires. As well, all applications (both new and renewal) are subject to a $100 fee.

The requirement of a certificate of conduct aligns Newfoundland and Labrador with most provinces and the five-year term length is amongst the longest in Canada.

Members of the public who are 19 years of age or older and are Canadian citizens or permanent residents can apply to be a Commissioner for Oaths. Appointments are made by the Minister of Justice and Public Safety in accordance with the Commissioners for Oaths Act.

Appointees are considered in a position of trust and play an important role in the proper completion of legal documents, in particular the administration of Oaths and Affirmations for Affidavits and Declarations. Each month, the province receives between 100-200 new and renewal applications for Commissioner for Oaths.

Mayors of municipalities, barristers and Members of the House of Assembly will remain Commissioners of Oaths by virtue of office.
