| Report: | A-2026-007 |
| Report Date: | March 25, 2026 |
| Public Body: | Commissioner for Legislative Standards |
| Summary: | The Complainant made an access request to the Commissioner for Legislative Standards (“CLS”) for public disclosure statements and extra benefits statements about members of the House of Assembly. CLS made records available for inspection but refused to provide copies, citing provisions of the House of Assembly Act. This Report finds that there was a conflict between the House of Assembly Act and the Access to Information and Protection of Privacy Act, 2015 (“ATIPPA, 2015”) but that the conflict was resolved by section 7 of ATIPPA, 2015 (conflict with other Acts) and that ATIPPA, 2015 prevails. It is therefore recommended that the responsive records be provided to the Complainant. |
