| Summary: | The Complainant made two access to information requests under the Access to Information and Protection of Privacy Act, 2015, to the College of the North Atlantic seeking internal records and aggregate legal fees related to a number of court matters. The College responded by withholding all responsive records under section 30 (legal advice) of the Act. The Complainant was not satisfied with this response and filed a complaint with this Office. The College refused to provide any of the responsive records to this Office, including those over which it had claimed litigation privilege, despite this Office issuing a summons for those records. The Commissioner found that the College had not conducted a reasonable search for records, and that it had not met its burden with respect to the claims of solicitor – client privilege and litigation privilege. Therefore, the Commissioner recommended release of all responsive records to the Complainant. |
