CRIMS: 01-05 Executive Functions – Cabinet Records

Description:

Use for records related to the Cabinet decision making process. Pursuant to Section 5.4 (1) of the Management of Information Act (MOIA) Cabinet Secretariat has overall responsibility for determining how Cabinet Records shall be managed. Cabinet Submissions, also referred to as Memorandum to Executive Council, are the key instruments of written policy advice to Cabinet. Draft Cabinet papers are circulated by a department to other departments for feedback. This feedback is used to finalize the cabinet paper for Ministerial signature. When the paper is signed by the Minister it is submitted to Cabinet Secretariat for review and routing to Cabinet Committees. The Committee makes a recommendation for the consideration of Cabinet. Following Cabinet consideration, a Minute of Council and, where required, an Order in Council is prepared outlining the approved course of action for departmental or agency implementation.

Filing Guidelines: Records are to be securely retained on site until final disposition. It is the responsibility of the Departments to ensure all copies, regardless of media, are securely disposed when applicable. Departments should retain a permanent copy of the record of disposal.

41 Final Cabinet Submissions

A final Cabinet Submission is composed of the Cabinet Submission document and Submission attachments. The final submission is formally submitted to Cabinet Secretariat by the  relevant Minister(s). A submission is considered final only when signed by the Minister.

42 Draft Cabinet Papers

Records include all versions of a paper that exist in a department prior to circulation for review outside of the department.

Note: Excludes any legal advice or other commentary provided by JPS (legal).

Event date (ED) equals date the cabinet paper is finalized and signed by the minister for submission to Cabinet Secretariat.

43 Departmental Cabinet Papers Received for Review

As part of the cabinet decision-making process, departments are given the opportunity to comment on other departments draft and final cabinet papers. Records include documents that track feedback provided to departments.

45 Minutes of Council (MCs)

Minutes of Council are the formal records of decisions of Cabinet. They are the mechanism for providing direction to ministers and departments/agencies and are not publicly available due to their confidential nature.

46 Orders in Council (OCs)

Orders in Council are Cabinet decisions that require the consent of the Lieutenant Governor in Council. They are a mechanism for providing direction to ministers and departments/agencies. Orders in Council are considered subordinate legislation.
