The Honourable Bernard Davis, Minister of Environment and Climate Change, has announced the following events relative to Part 10 Environmental Assessment of the Environmental Protection Act.

Undertaking Registered:

Indian Bay Heritage Walking Trail                                                         (Reg. 2201)
Proponent: Town of Indian Bay

The proponent proposes to develop a walking / hiking trail along Indian Bay Brook, near the Town of Indian Bay, Northwest Arm. The trail will utilize an existing logging trail route that dates back to the early 1930’s. The majority of the trail will be located along Indian Bay Brook for a length of approximately 1.5 kilometres.  A description of the project can be found on the Department’s web page at https://www.gov.nl.ca/ecc/env-assessment/projects-list/.

The undertaking was registered on June 1, 2022; the deadline for public comments is July 8, 2022; and the minister’s decision is due by July 16, 2022.

Environmental Preview Report Required:

Carmanville New Pond Cabins Access Road                                    (Reg. 2186)
Proponent: Wayne Hicks

The minister has advised the proponent that an environmental preview report (EPR) is required for this project. Additional information is needed to inform the minister of the following, including, but not limited to: a description of the proposed alternative all-terrain vehicle route; details of construction methods; and, location map(s) of the proposed alternate route.

An Environmental Assessment Committee (EAC) has been appointed to provide scientific and technical advice to the minister and to draft guidelines for the proponent for preparation of the EPR. The EAC includes representatives from the following provincial government departments and agencies:

  • Department of Environment and Climate Change
    • Environmental Assessment Division – Chair
    • Water Resources Management Division
  • Department of Fisheries, Forestry and Agriculture
    • Crown Lands Division
    • Wildlife Division

Environmental Preview Report Required Continued:

Foxtrap Incinerator Road NORM Storage and Decontamination Facility                               (Reg. 2166)
Proponent: Pardy’s Waste Management and Industrial Services Limited

Pardy’s Waste Management and Industrial Services Limited has advised that the request to withdraw the Foxtrap Incinerator Road NORM Storage and Decontamination Facility (Reg. 2166) project from environmental assessment was made in error, and Pardy’s fully intends to proceed with submitting an environmental preview report (EPR), as required by the minister, within the time allotted by the legislation. The announcement in the May 27, 2022 edition of the Environmental Assessment Bulletin, withdrawing the project from environmental assessment, is rescinded.

Report Approved:

CBPP Zone 3 Five-Year Forestry Operating Plan (2022-2026)      (Reg. 2146)
Proponent: Corner Brook Pulp and Paper Limited

On June 2, 2022, the minister approved the Stakeholder Engagement Report for the Southwest Gander Operating Area (K-06-07) in CBPP Zone 3 Five Yr Forestry Plan (2022-26). The approval of this report is a condition of release for the project. The report is available on the Department’s project web page at https://www.gov.nl.ca/ecc/projects/project-2146/.

Undertaking Released:

Green Bay Sawmill Production                                                         (Reg. 2190)
Proponent: Green Bay Logging Limited

The project was released subject to the following conditions:

  • The proponent is required to uphold all commitments made in the environmental assessment submission to mitigate the effects of the project on the environment.
  • The Pollution Prevention Division of the Department of Environment and Climate Change requires that the proponent submit a Waste Management Plan that identifies the management of all potential waste streams, including spoilage, slabs, wood chips, and sawdust generated at the facility. Contingency plans must be included that identify disposal options in the event that these waste streams cannot be fully utilized.
  • The Water Resources Management Division of the Department of Environment and Climate Change advises that as per 1:50,000 topographic mapping, a stream flows across the northeast corner of the property boundary, and the proponent must maintain a 15-metre undisturbed buffer from the stream for all activities.
  • The proponent is required to advise the Environmental Assessment Division when the conditions of release have been met by emailing a written description, documents, and images (where applicable) to demonstrate that the conditions have been fulfilled to EAProjectComments@gov.nl.ca.
  • The proponent is required to update the Environmental Assessment Division on the status of the project, including a copy of all  permits, licences, certificates, approvals and other authorizations required for the project, one year from the date of this release letter and to provide additional updates if required. Project updates should be emailed to EAProjectComments@gov.nl.ca.
