Eligibility for Internal Competitions Policy

Policy Statement

Internal competitions are open to persons considered to be internal applicants as defined by this policy.

Application

This policy applies to all organizations specified in Schedule A of the Public Service Commission Act, and to positions in those organizations not otherwise excluded by Section 4 thereof.

Definitions

For the purpose of this policy:

Internal Applicant – the following are considered internal applicants:

  • a person who is employed on a permanent, temporary, seasonal, part-time or casual basis with the public service;
  • a bargaining unit employee who is on lay-off status from the public service for a period of two years from the date of lay-off;
  • a management employee or non-bargaining unit employee who is on lay-off status from the public service for a period of two years from the date of lay-off; and
  • contractual employees while under current contract with the Government of Newfoundland and Labrador.

The following are not considered internal applicants:

  • a student hired in a student position for a specific term; and
  • political support staff.

Public Service – the Public Service Commission Act defines public service as:

  • the departments and other portions of the public service of the province specified in Schedule A;
  • an office, body or agency considered by the Lieutenant-Governor in Council to be a portion of the public service and added to Schedule A under Section 3 of the Act; and
  • the House of Assembly establishment and the statutory offices of the House of Assembly.

Selection Board Chair – an official acting on behalf of the PSC on selection boards, convened to conduct competitions for the recruitment of public service positions.

Roles and Responsibilities

Candidate

It is the responsibility of the candidate to:

  • clearly demonstrate eligibility to apply for internal positions.

Selection Board Chair

 It is the responsibility of the Selection Board Chair to:

  • confirm eligibility of all candidates.

Public Service Commission

 The Commission shall:

  • monitor and audit to ensure compliance with this policy;
  • provide guidance and interpretation of this policy; and
  • adjudicate complaints related to the application of this policy pursuant to the Public Service Commission Act.
