10.0 Appeals

The issuance of a positive JVA is at the sole discretion of the Department of Immigration, Population Growth & Skills. Applications will be assessed to ensure the employer’s eligibility and that available labour market information supports the need to hire international workers.

Applications that result in a negative assessment, will receive a written rationale, outlining the reasons for refusal. Employers will have ten (10) business days to submit additional supporting evidence to demonstrate eligibility such as outstanding documentation, proof of additional recruitment methods, results of recruitment efforts etc.

If IPGS (LMDOs) does not receive additional supporting evidence within ten (10) business days, the file will be officially closed, and employers will be required to reapply for a Job Vacancy Assessment consideration by an LMDO.
