Breakdown of Fines

Banned Lawn Care Active Ingredients
In 2012, Newfoundland and Labrador banned the use of the following active ingredients:

  • MECOPROP;
  • 2,4-D;
  • DICAMBA;
  • MCPA;
  • and CARBARYL;

These active ingredients are no longer allowed to be used on lawns. Golf courses, forestry activities or agricultural activities are exempt from these regulations.

Pesticide Licenses
Individuals and/or businesses looking to store, use or apply pesticides must acquire the proper licencing. Different classes of pesticides require the corresponding class of licence. When acquiring a pesticide licence please ensure the class of the licence coincides with the class of pesticides you will be using.

Insurance
Those looking to obtain a licence must submit satisfactory evidence of Insurance. The Insurance must be a valid and existing liability insurance policy of a type and in an amount required by regulation. If during the duration of the licence the insurance policy is revoked, cancelled or terminated, the licence is to be considered cancelled.

Pesticide Storage
Individuals who keep, store or transport pesticide must ensure that pesticides do not come into contact or contaminate food and drinks that are consumed by humans, animals or plants. As well, the precautions and warnings on the label of a pesticide package must be followed.

Using Pesticides
When using pesticides individuals must not handle the pesticide in any manner or quantity other than that in the regulations. If no regulations can be found regarding the pesticide, the instructions of the manufacturer must be followed.

Violation of the Operator’s Licence Terms and Conditions
Businesses that acquire an Operator’s Licence must abide by the license’s terms and conditions.

Violation of the Applicator Terms and Conditions
Individuals holding an applicator’s licence in the agriculture category must abide by the license’s terms and conditions.

Improper Sale or Purchase of Pesticide
A pesticide vendor who sells domestic class pesticides shall not sell pesticide and fertilizer products that are blended together.

A person or business shall only possess a commercial or restricted class pesticides if obtained from a commercial pesticide vendor.

A commercial pesticide vendor must not sell a commercial or restricted class pesticide to anyone other than a

  • Licenced Pesticide Operator

A commercial pesticide vendor may only sell a commercial or restricted class pesticide to a person who holds a valid operator’s licence or;

  • An Applicator who holds a Valid Agricultural Licence
  • An Applicator who holds a Valid Greenhouse Licence

Commercial pesticide vendor must maintain records of the sale as required by the minister.

A commercial or restricted class pesticide may be purchased from a vendor who is located outside the province and who does not have a licence if;

  • A Licenced Pesticide Operator obtains a permit for the purchase of the pesticide from the minister, or a person designated by the minister.
  • A Pesticide Applicator with a Valid Agricultural Licence obtains a permit for the purchase of the pesticide from the minister, or a person designated by the minister.
  • A Pesticide Applicator with a Valid Greenhouse licence obtains a permit for the purchase of the pesticide from the minister, or a person designated by the minister.

Failure to Provide or Wear Protective Clothing
Pesticide Operators must provide protective clothing and equipment stated on the pesticide label or by minister or a person designated by the minister to applicators on staff. Operators must also ensure that protective clothing and equipment is used by applicators.

Pesticide Applicators must ensure that they wear protective clothing equipment and wore by an unlicensed assistant when using, handling, or disposing of pesticides.
